Art. 1 ORGANIZATION – EVENT DATE AND VENUE
Assomac Servizi Srl (hereinafter the Organizer), in collaboration with Fiera Milano S.p.A., organizes SIMAC TANNING TECH 2021 (SIMAC and TANNING-TECH, International Exhibitions of Machines and Technologies for Footwear, Leathergoods and Tanning Industry) (hereinafter the Exhibitions) from 22 to 24 September 2021 in Fiera Milano Rho pavilions.
Art. 2 EXHIBITIONS DATES AND TIMES
The Exhibitions are open to Visitors the first two days from 9 am to 6.30 pm and the last day from 9 am to 5 pm.
The Exhibitions are open to Exhibitors the first two days from 8 am to 7 pm and the last day from 8.30 am to 5.30 pm.
The Exhibitors must be present on the stands when the Exhibitions are open. The Organizer reserves the incontestable right to change the schedule of the Exhibitions and the date of the events. The Exhibitor undertakes, from now on, to participate in the Exhibition, even in the event of a unilateral change in the dates, under the same terms and conditions as set out in these Regulations.
Children under 14 years are forbidden to enter the halls. For children aged from 15 to 17 years access is allowed only when accompanied.
It is forbidden to bring animals of any breed into the pavilions, except for dogs serving disabled people.
Art. 3 PERMITTED PRODUCTS
SIMAC - The following products are admitted:
- Model creation and prototyping systems (dedicated software such as CAD, CAM and specific hardware such as 3D printer, etc.);
- Shoe lasting machinery;
- Footwear manufacturing and repair machinery and technologies;
- Leathergoods machinery and technologies;
- Machinery for component and product manufacture systems (natural/manmade materials);
- Accessories machinery and technologies;
- Accessories and products of the manufacturing process, including chemical ones, for the above machinery;
- Moulds and die cutters, cutting systems and similar;
- Material, semi-finished and finished goods conveyor systems;
- Management, logistic, production cycle and phase systems – Automation, robotics;
- Machinery and equipment for material, component and finished-product testing;
- Various organizations, Associations and technological Centers, trade press.
TANNING-TECH - The following products are admitted:
- Tanning machinery and technologies;
- Tanning machinery accessories;
- Solid, liquid and gaseous waste treatment systems and equipment;
- Lab machinery and equipment;
- Management and software of production cycle and phase systems – Automation, Robotics;
- Accessories and products of the manufacturing process, including chemical ones, for the above machinery;
- Consumables, auxiliaries and special materials for process of leather and similar one;
- Various organizations, Associations and technological Centers, trade press.
If the exhibiting company also produces or represents manufacturers of products not included in the listed ones, these will only be allowed upon explicit written request to the Organizer.
It is absolutely forbidden to display machinery and/or accessories that are not factory-new; therefore the publication ofused machinery is also forbidden. Should this occur, despite checks at the entrance, machinery must be removedimmediately from the stands simply at the request of the Organizer, which also reserves the right not to accept companies that fail to comply with this rule at subsequent events.
The participating company will be directly responsible for compliance with the regulatory provisions on industrial, intellectual property, trademarks and patents, is committed to respecting intellectual property rights and not showing / displaying copies. It should be noted that, in the event of a dispute with another Exhibitor, the Organizer, from a legal point of view, is not entitled to take action against anyone who infringes intellectual property rights, such as removing products or closing stands on the spot (IP management trade fair 2017 EU). In any case, the Organizer reserves the right not to admit companies that repeatedly fail to comply with the previous provisions to subsequent events.
Art. 4 ADMITTED EXHIBITORS
Italian and foreign manufacturers and distributors of the products listed in Art. 3 as well as agents, representatives andretailers are accepted as Exhibitors. If a manufacturer exhibits its products directly, they may not also be presented by anagent, representative or retailer, even if relabelled and/or rebranded, unless otherwise decided by the Organizer.
If so requested, exhibiting companies must present their certificate of registration with the respective Chamber of Commerce proving their status.
The Organizer reserves the right to exclude certain services, products and samples from the Exhibitions and to excludethe presentation of said products, samples and services on more than one stand in the same product sector.
Represented Companies – it is also possible to present applications for any represented manufacturers, as occupants of an Exhibitor’s stand. In this case, the “Represented Companies” space in the Application Form must be filled in for each manufacturer represented and, for each of them, the relative form "Catalogue Data for the represented company" must be completed. For each Represented Company the registration fee of Euro 750,00 (Euro 1.000,00 less 25% benefit for COVID virus valid for 2021 edition only) + VAT, if owed, must be paid; this gives entitlement to inclusion in online SIMAC TANNING TECH catalogue, in the Visitor’s Guide and in all the lists showing the exhibiting companies.
Failure of the Exhibitor to indicate in the Application Form the name of the companies in the "Represented Companies" list implies that the latter may appear in any way (including the presence of their name, trademarks or their products) as Exhibitors in the stand, in the Visitor’s Guide and in the online Catalogue of the Exhibitions.
In the case of subdivision of the assigned exhibition area with fixed structures in favor of Represented Companies, the written communication to the Organizer is necessary, which reserves the right to accept any proposed provision.
Art. 5 PHOTOGRAPHS, FILMING, VIDEOS
Products/goods on display and their stands may not be photographed, drawn or reproduced without the authorization ofthe relative Exhibitor and the Organizer.
Use of Exhibitor images acquired during the Events
In relation to the images of the Exhibitor, their stand and/or representatives, members, employees and workers, acquired or recorded in any way (such as using cameras, video cameras or audiovisual recordings) during the Events, the above mentioned Exhibitor declares to be aware, pursuant to European (EU) General Personal Data Protection Regulation 2016/679, that the Organizer and Fiera Milano S.p.A. may collect and process said images and disseminate them for informative, promotional and commercial purposes, and therefore grants the Organizer and Fiera Milano S.p.A. the free use of these images, for these purposes, as per articles 96 and 97 of Italian Law no. 633/1941, authorizing the Organizer and Fiera Milano S.p.A. to use them through any means of communication (including, for example, brochures, presentations, catalogues and, in general, all the printed material necessary for their disclosure and promotion, TV, pay-per-view, etc.) and dissemination via internet (companies website, social networks, etc.) or via magazines and other publications, including digital ones, with the rights to adapt and reproduce them for all legal purposes. For this purpose, the Exhibitor declares and guarantees the Organizer and Fiera Milano S.p.A. to have:
1) obtained the authorization of the data subjects for the processing of the data relative to their photos, video recordings etc. by the Organizer and Fiera Milano S.p.A., including their dissemination for informative, promotional and advertising purposes pursuant to the terms of the European (EU) General Personal Data Protection Regulation 2016/679;
2) obtained the authorization for the use and dissemination of the images, pursuant to Articles 96 and 97 of Italian Law no. 633/1941 on copyright, in the above mentioned terms, from the natural persons portrayed or recorded, their representatives, members, employees and workers during the above mentioned Events.
In relation to the previous sections 1) and 2), the Exhibitor undertakes to indemnify and hold the Organizer and Fiera Milano harmless from all disputes, actions or claims that may be raised by the above mentioned persons with regard to the indicated use and disclosure of the relative images described above.
Art. 6 APPLICATION FORM
The completed Application Form, duly signed by the Legal Representative of the applicant company, must arrive at

within and no later than 4 June 2021 for the purpose of assigning the exhibition space. After this date, the spaces will be granted until the display area is depleted and the application forms will be taken into consideration compatibly with the availability of space, without guarantee of participation or of any visibility equivalent to the areas originally available.
Only the application forms completed and signed in accordance with these General Regulations and accompanied by thepayment required under Art. 9 “Terms of Payment - Exit Pass” shall be accepted. The exhibiting companies must not have overdue payments accrued against any service provided to them by Assomac Servizi Srl or by companies connected to it. Participation in one or more previous editions of the Events does not give the Exhibitor any right to automatically participate in a subsequent edition.
The Application Form of agents and exclusive or general representatives must be accompanied by a list of the manufacturers they represent, and whose products they intend to display.
Applicants are required to provide the Organizer with any other documentation that may be asked to proceed with the acceptance of the application and to ascertain compliance – at all times – with the General Regulations of the Exhibitions.
By endorsing the Application Form and General Regulations, the Exhibitor formally promises to attend the Event and toaccept the instructions of these General Regulations and any subsequent supplements, changes and derogations adoptedby the Organizer, as well as the rules contained in Technical Regulations of Fieramilano Exhibition Center.
The exhibiting space can be requested ONLY FOR LOTS OF 16 M² AND ITS MULTIPLES, unless otherwise provided by the Organizer.
Art. 7 FEES
- The basic fee for the exhibiting space is Euro 190.00/m² for raw spaces. A benefit for COVID virus, valid for 2021 edition only, is deducted from this amount for a total of Euro 180,00/m² as per the Application Form.
- The fee for a standard furnished booth is Euro 95.00/m², excluding any customizations.
- The fee for each open corner requested in the Application Form is Euro 550.00.
- The fee for spaces used to construct raised platforms is Euro 150.00/m² (unfurnished).
- The Exhibitor registration fee is Euro 1,000.00. A benefit of 25% COVID virus is deducted from this amount for a total of Euro 750.00. This benefit is valid for 2021 edition only.
- The fee for flat services is Euro 180.00 for each lot of 16 m².
- The registration fee for each Represented Company is Euro 1,000.00. A COVID benefit of 25%, valid for 2021 edition only, is deducted from this amount for a total of Euro 750.00.
Statutory VAT, if due, must be added to the total. Those exempt from VAT under Art. 8/8bis/9 of DPR 633/72 and amendmentsmust attach three declarations of intent: one addressed to Assomac Servizi Srl, one addressed to Fiera Milano S.p.A. and one addressed to Telecom Italia S.p.A. for any additional services. From 1 January 2011, under D.Lgs. no. 18/2010,implementing EU Directive 8/2008, foreign Exhibitors that are taxable persons no longer need to pay VAT on the Event feeand services unless they are non VAT taxable persons (e.g. private). In order to identify the type of client (taxable/ non-taxable person), the Organizer must receive information regarding the VAT/ID code or other suitable documentation proving company rather than private status before the invoice is issued.
It is, therefore, absolutely vital that application forms are accompanied by the above information; otherwise, the Organizer shall be forced to issue invoices subject to Italian VAT.
The Organizer reserves the right to apply fee concessions to exhibiting companies in reflection of and proportional toadditional activities executed for Event organization; such concessions are in no way discriminatory.
Electronic billing between private individuals
In order to comply with the obligations introduced by Art. 1, co. 909, Law of 27 December 2017 (obligation from 01/01/2019 to issue an electronic invoice between private individuals), the Italian Exhibitor will take care to communicate to the Organizer its certified e-mail address (PEC) and / or its seven-digits recipient code.
Art. 8 SERVICES INCLUDED IN THE FEE
- As well as the stand area, basic fee includes following services:
- stand sign panel;
- addition to Exhibitions website and web APP;
- web APP “Simac Tanning Tech” with additional services for B2B events dedicated to the Exhibitor;
- admission passes for Exhibitor’s staff;
- parking passes in a number proportional to the stand size:
- n. 1 pass up to 32 sqm
- n. 2 passes up to 96 sqm
- n. 3 passes up to 128 sqm
- n. 4 passes more than 128 sqm
additional parking passes can be booked via Exhibitor Platform for the duration of the Events and at the rates shown in the online platform;
- digital customer invitation and promotional material;
- technical assistance during the exhibition, stand installation and dismantling;
- general surveillance of the pavilions (special surveillance services can be hired through Exhibitor Platform);
- Complementary events arranged by the Organizer regarding conventions, conferences and celebrating events as in the Exhibitions programme, including the hospitality of delegations of trade operators, of Italian and foreign State Authorities and of conference speakers.
- The fee for flat services covers:
- Installed electric power up to 5 kW;
- Stand cleaning during the exhibiting period: cleaning of floor and any coverings, such as carpet (washing of carpet and removal of stains or traces from it is excluded); dusting of furniture (excluding those on display) installed in the stand; emptying of waste bins; furnishings, materials, equipment and products on display are excluded from the service;
- legally compliant fire extinguisher provision;
- WiFi connection in pavilions;
- Municipal advertising tax (Art. 14);
- Payment of royalties resulting from eventual audio-visual installations on stands, that are subject to legally required payments. This cover does not however include live music performances (with singers and/or musical instruments) for which the Exhibitor must deal with directly at the local SIAE offices. It is also included the royalties due to performers of music or to record companies that own recording rights as per arts. 72 and 73/bis Law 633/1941 and for their account SCF-Società Consortile Fonografici.
If the services, included in the fees or contracted separately, are provided by third parties directly to the Exhibitor, the Organizer, in its own name and on behalf of the Exhibitor, enters into the respective contracts, but takes no responsibility for execution by the third party. By signing the Application Form, the Exhibitor authorizes the Organizer with the related powers.
N.B. The assigned exhibition space does not include health prevention equipment. Therefore it will be the exhibitor’s responsibility to adopt the appropriate prevention solutions in accordance with the public health provisions and regulations in force during the period of the event.
Art. 9 TERMS OF PAYMENT – EXIT PASSES
In accordance with Art. 7, Exhibitors are obliged to pay at the time of sending their Application Form:
- Euro 750.00 as registration fee (COVID benefit valid for 2021 edition only) for the Exhibitor;
- Euro 180.00 for each lot of 16 sqm for flat services;
plus legally required VAT on the total, if due. The payment may be arranged exclusively by bank transfer to Assomac ServiziSrl, BANCO DI DESIO E DELLA BRIANZA - Vigevano branch - IBAN IT67 J034 4023 0000 0000 0308 300 - BIC/Swift: BDBDIT22.
In case the Application Form is sent without the Exhibitor having paid the registration fee and the amount for flat services, in accordance with the terms and conditions indicated therein, the participation contract will be terminated with the Organizer's right to propose the area previously booked by the defaulting Exhibitor to other Exhibitors.
If the application is not accepted, the registration fee and the amount for flat services will be returned.
The balance will be invoiced within the end of July 2021 (COVID benefit valid for 2021 edition only) and must be paid within September 10, 2021 and in any case before accessing the Exhibition site.
This amount includes:
- Euro 180.00/sqm of assigned area;
- Euro 550.00 for each assigned open corner;
- Euro 750.00 (COVID benefit valid for 2021 edition only) for each Represented Company;
- The cost of furnished booth, if required;
- Euro 150.00/sqm of raised platforms, if required.
Only Exhibitors with no outstanding payments shall be admitted to the Exhibition site to install and prepare the stands.
- Traceability of financial transactions with the public administration - In compliance with current legislation, a specialnon-exclusive current account has been opened for public- body payments; details will be provided on request.
- Payment of account statement of Fiera Milano - During the Exhibitions days the accounting department of Fiera MilanoS.p.A. will summarize in a bank statement all invoices issued for additional services and supplies not yet paid as well as anyother charges. Any objections to wrong charges set out in the statement should be represented within the closing of theExhibitions, after this deadline they will not be accepted any more. The statement of account will be published in theExhibitor Platform and the payment from Exhibitor can be arranged directly from his own office by bank transfer or bycredit card by accessing the Exhibitor Platform or directly in the Exhibition Center through Totem located in the halls orby presenting the statement of account to the banks of the Exhibition Center, compulsorily before the end of Exhibitions.
- Exit Passes - Exit passes allow Exhibitors to leave the Exhibition Center, provided that they have assumed all theirobligations against Fiera Milano S.p.A. and the Organizer and consequently after payment of due amounts to Assomac Servizi Srl and to Fiera Milano S.p.A. Exit passes are required to remove exhibits as well as set-up materials and anything else pertaining toExhibitors at the end of the event and they must be shown to the surveillance guards at the gates of the Exhibition Center. Exit passes can be displayed or downloaded from the Exhibitor Platform.
Art. 10 STAND ALLOCATION
Acceptance of Application Form and stand allocation shall be decided by the Organizer unquestionably. Even if the Application Form is submitted within the time allowed, this does not give any right to its acceptance or to the provision of an exhibiting area.
Any special suggestions or requests, open corners included, by the Exhibitor shall be purely indicative and cannot restrict or condition the Application Form; as such they are ignored.
Final confirmation of stand allocation occurs through a “Notification of Stand Allocation” issued by the Organizer and not following the confirmation of allocation approval by the Exhibitor.
Stands are grouped, wherever possible, by product category; however for technical and/or organizational needs, the Organizer reserves the right to change, reduce or alter the allocated stand or to transfer it to another exhibiting zone. Such achange does not give the Exhibitor the right to withdraw his Application Form or to compensation for any damages. In all cases, the Exhibitor cannot for any reason or motive sue the Organizer for damages.
If for technical-organizational reasons a stand with open corners is assigned to an Exhibitor who did not request it, the surcharge for open corners provided for in Art. 7 must be paid just the same. Likewise if for technical-organizational reasons an area with the requested open corners cannot be assigned, the eventual surcharge will not be calculated in the invoice.
Stands may only be used on the area and in the position stated on the documents issued by the Organizer. Stand transfer,even if free of charge or only partial, is strictly forbidden. In case of a verified breach, the Organizer may expel the goodsintroduced and exhibited, at the stand holder’s liability and expense.
Art. 11 WITHDRAWAL
Any attendee who, for serious reasons and/or supervening impossibility, is unable to attend the event, may withdraw from the contract by documenting this impediment and notifying the Organizer by registered letter with return receiptat least 60 calendar days before the Exhibitions opening date, without prejudice to the acquisition, by way of compensation, by the Organizer of the registration fee and the amount for flat-rate services, without prejudice to any further right to compensation for any greater direct and indirect damages.
If, on the other hand, said communication is received less than 60 calendar days before the Exhibitions opening date,the attendee will not be relieved of the obligation to pay, in addition to the registration fee, even the full exhibitionfee, again without prejudice to the Organizer’s right to request compensation for any further direct or indirect damages. In such case, the Organizer may still dispose of the stand, even assigning it to other Exhibitors.
If the notice of withdrawal is not notified in the manner and terms mentioned above and the Exhibitor does notprepare his stand, he shall be considered in default to all effects and will be required, as well as paying the registration fee and the full exhibition fee, to reimburse any direct or indirect damage suffered by the Organizer.
Even in this case, the Organizer may still dispose of the stand even assigning it to other Exhibitors.
Even in the event of partial withdrawal from the assigned stand, the Exhibitor must pay the total amount of the exhibition fee, without prejudice to the possibility for the Organizer to dispose of the partially renounced stand, even assigning it to other Exhibitors.
As regards the waiver of participation by the Exhibitor limitedly for reasons attributable to the global health emergency (Covid-19), the rules expressed in Art. 43 of these Regulations will be specially applied.
Art. 12 PRINTED LITERATURE AND ONLINE INFORMATION
The Organizer shall produce the Catalogue and circulate information (also in synthetic or abbreviated form) contained InApplication Form regarding Exhibitors and products and/or presented services, as well as regarding anything else displayedor presented, using media and communication methods (printed material, Internet or other) he deems most fitting, withoutbeing in any way liable for any omissions, errors or malfunctioning.
Data reported shall refer to Application Forms received and accepted up to 45 days prior to Exhibitions opening date. All this does not prejudice the Organizer’s right to alter stand allocation. The above also applies to contents of otherinformation forms signed by the Exhibitor or his representatives and made available to the Organizer, also via computer.The Organizer reserves the right to provide areas on Exhibitions Internet sites reserved to the single Exhibitor who mayaccess via a personal Password and Username.
The Exhibitor is solely liable for contents entered into his reserved area and the proper use, also by third parties, of the Password and Username allocated to him by the Organizer.
The Organizer assures the utmost diligence in the compilation of the Catalogue and declines all liability for any errors oromissions. The Organizer will, if possible, remedy such omissions or imperfections in the timescale and manner he deems most fitting. The above applies to all other promotional, information and service literature prepared by the Organizer.
Art. 13 ADVERTISING: PROVISIONS AND PROHIBITIONS FOR ADVERTISING
Advertising within the Exhibition Center, excluding the advertising inside the Exhibitor’s stand, must be carried out exclusively through Fiera Milano S.p.A. or his delegated companies.
Each Exhibitor shall be entitled to carry out commercial activity within his own stand only for his own Company or his Represented Companies via promotional and advertising means strictly pertaining to product that the Exhibitor was authorized to exhibit at the Events. Any type of presentation not directly related to product on display, even if carried out to complete the set-up, is forbidden without written authorization from the Organizer. The Exhibitor declares and warrants that he is the lawful owner or that he has all the necessary concessions and/or authorizations according to law to use marks, designs, photos and any other general picture utilized for providing a service and to possess any license or permits that may be necessary for the use of trademarks or patents, right now relieving the Organizer of any consequent responsibility or damage that may arise for any claim or right by third parties and of any obligation of compensation.
It is forbidden to carry out wandering advertising in gangways, Fair passages and in the neighborhood of the Exhibition Center.
Art. 14 MUNICIPAL TAX ON ADVERTISING
Without prejudice to the exhibition rules, the Exhibitor is required to pay to Rho Municipality the tax due for anything deemed taxable under D.L. 507 dated 15/11/1993. Following agreements reached with Rho Municipality in the interests of the exhibiting categories, this tax is fixed as a flat-rate based on the area occupied at the Event.
In order to save the Exhibitors from complicated procedures, by signing the Application Form, the Exhibitor appoints the Organizer on his behalf and through Fiera Milano S.p.A. to make the relative payment of said tax to Rho Municipality, the sum of which is included in the services fee.
Art. 15 TECHNICAL REGULATIONS OF FIERAMILANO EXHIBITION CENTER
FIERAMILANO Exhibition Center Technical Regulations, available online (http://www.simactanningtech.it – section “Exhibiting” – “Technical Notes”), contain more detailed information on the following:
- Stand Installation/Dismantling: general regulations – design and construction – dismantling and returning of exhibiting area – calendar, opening times and extensions – cleaning – surveillance – air conditioning in pavilions – waste disposal and discharge of waste substances into the drain system – signboards – restocking – catering – regulations on advertising and promotional initiatives – product presentations and special events.

Regulations and instructions in “Technical Regulations” of Fieramilano Exhibition Center are, to all effects, an integral part of these General Regulations, which the Exhibitor and any represented Company declare to accept unconditionally.
Art. 16 EXHIBITOR PLATFORM: COMPULSORY DOCUMENTS, RESERVING SERVICES AND SUPPLIES
“Exhibitor Platform”, the Fiera Milano S.p.A. online platform, allows Exhibitors to order and hire everything needed for theirattendance at the Events. The Exhibitor will receive an email sent directly by Fiera Milano S.p.A. to the address of the personnamed responsible for the procedure containing credentials to access the service, where he will find for reference andcompletion all documents concerning insurance, technical services and safety, which must be completed. Defaulting Exhibitors will not be allowed to enter the Exhibition center for stand installation and fitting-out operations. In the Exhibitor Platform, Exhibitors may also view and request estimates for installations and sundry services performed by Fiera Milano S.p.A., as well as any business services.
Exhibitors can also access the "Logistics" section for crediting people and vehicles during the assembling and disassembling days.
Art. 17 FOOD AND CATERING SERVICES
Exhibiting companies can apply for Fiera Milano S.p.A. food and catering services in the respective section of the Exhibitor Platform and/or by contacting ristorazione@fieramilano.it – tel. (+39) 02. 4997.6365/7425/7805.
Third party catering companies and Exhibitors who wish to offer food and drink to their guests of their own accord can purchase passes for access and resupply when submitting the necessary documentation.
The procedure is available on the Obligatory Documentation - Catering section of the Exhibitor Platform and in Fiera Milano Technical Regulations.
In accepting these General Regulations, Exhibitors who provide their own catering separately from services provided by Fiera Milano S.p.A. declare that they are aware of the provisions of the Italian Prime Ministerial Decree of 17 May 2020 and its amendments and agree to observe its requirements.
Art. 18 CUSTOMER SERVICE – ASSISTANCE TO EXHIBITORS
The service is provided directly to Exhibitors for services of Fiera Milano S.p.A. competence under his exclusive responsibility.
Customer Service - Exhibitors Assistance provides all useful information for preparation, operation and dismantling of stands and to arrange all technical services requested by the Exhibitor to Fiera Milano S.p.A.
Application for any extensions of opening hours should also be made to Customer Service - Exhibitors Assistance.

Art. 19 OFFICIAL FORWARDER
The Official Forwarder of Fiera Milano S.p.A. is available to carry out any operation connected with customs clearance and introduction of machines and materials, including crane service and packaging collection, custody and return delivery service; as well as at the end of the Events for the return of materials.

Art. 20 STAND AVAILABILITY
Stand availability for materials arrival and departure and timing for installation and dismantling are shown in the schedule that will be forwarded by Fiera Milano S.p.A. afterwards.
The Organizer may otherwise dispose of the stands whose set-up has not taken place within the 24 hours prior to the opening of the Events. In this case the Exhibitors, to whom these stands were assigned, remain in any case debtors of the participation fee and the amounts for the services provided.
During the Events the Exhibitor is required to be present on the stand with his own articles / machinery.
The abandonment and dismantling in advance of closing time established for the last day of the Events is strictly prohibited.
Art. 21 FURNISHED STANDS
To facilitate Exhibitor attendance at the Events, provision was made for stand set-up to be carried out by Fiera Milano S.p.A. on behalf of the Organizer, for stand sizes up to 48 square meters, the costs of which must be added to the cost of the exhibiting area. The details of the offer are shown in a special table. Furnishings of areas greater than 48 square meters must be requested and agreed with the Organizer.
The request must be made at the time of submission of Application Form or in any case not later than 26 July 2021.
The waiver of furnished stands after 23 August 2021 deadline is not permitted.
In case of cancellation after this date, the Exhibitor will still be required to pay the amount due for the booked set-up.
Furnished stands will be delivered the day before the Events.
Art. 22 FITTING OUT – RAISED PLATFORMS – HANGING LOADS FROM CEILINGS
All parts of stand design must remain within the area of the allocated stand.
Maximum height of stands is 3,50 m excluding machinery of higher height.
For safety reasons, the positioning of continuous walls to close the stands on each single open side, even with different elements, longer than 40% of the side itself or of the exhibiting front, is not permitted.
The designs for stands with an area equal to or in excess of 100.00 m² or a height equal to or in excess of 3.00 m must be sentcompulsorily to Fiera Milano S.p.A. for approval no less than 60 days before the Events open.
For American style reticular beams the maximum height allowed is:
- 5.00 m from the floor above ground, with 1,00 m high logos, graphics or commercial images. On the side bordering with another exhibitor, such structures should be free of graphics.
- 6.00 m from the floor above ground for lighting only.
Trademarks, company logos and advertising materials, erected on structures different from American style reticular beams, can reach a maximum height of 4.00 m. In case they are facing the neighboring stands, they must be positioned at least 1.50 m away from the borders.
In order to avoid presentations with an aesthetically unpleasant effect, the fittings must also be adequately finished on the external surface of the stand. In particular, all sides of the partitions adjoining other Exhibitors, must be finished and painted with white paint and must not have wording or advertising signs.
Stand designs and their systems must be constructed to the highest standards, compliant with accident and fire prevention regulations.
All specific safety regulations regarding activities contracted by the Exhibitor to contractors (stand installation and dismantling and related activities) must be complied with.
In the case of subdivision of the assigned exhibition area with fixed structures in favor of Represented Companies, the written communication to the Organizer is necessary, which reserves the right to accept any proposed provision, as already specified in Art. 4 of these Regulations.
Specific instructions and detailed regulations are available in Fieramilano Exhibition Center Technical Regulations in website http://www.simactanningtech.it – section “Exhibiting” – “Technical Notes”.
Raised platforms
The construction of raised platforms is permitted in the exhibition areas not less than 90.00 m² in all Exhibition Site pavilionswith the exception of two-level pavilions (8, 12, 16, 20), where it’s possible to construct raised platforms with special conditions.
The maximum height of the installation should not exceed 5,00 m from the pavilion floor.
The height beneath the raised platform should not be less than 2.70 m.
Authorization for construction is subordinate to the Organizer’s consent and Fiera Milano S.p.A. (Customer Service –Assistance to Exhibitors) approval of the design.
The Organizer must receive applications stating the size in square meters of the raised area at least 60 days before stand work begins.
The raised area is subject to the exhibition fees contained in Art. 7 and will be charged in the balance invoice.
The design of a stand with a raised platform must be sent to Fiera Milano S.p.A. (Customer Service – Assistance to Exhibitors) for approval.
The “Regulations for the construction of raised platforms in exhibition areas in Fieramilano Exhibition Center” can beviewed in “Technical Regulations of Fieramilano Exhibition Center” at http://www.simactanningtech.it (section “Exhibiting” – “Technical Notes”) and are, to all effects, an integral part of these General Regulations.
The Exhibitor and any person appointed to work on his behalf are liable for non-compliance with the instructions of “Technical Regulations of Fieramilano Exhibition Center” and answer jointly and severally for any ensuing onus.
Hanging loads from ceilings
It is allowed, subject to a feasibility check with the office in charge of Fiera Milano S.p.A., to hang American style reticular beams at a maximum height of 5.00 m from the floor above ground.
It’s possible to affix to these structures logos and graphics with a height not exceeding 1.00 m.
On the side bordering with another exhibitor, such structures should be free of graphics.
To order this service, please fill in and send to Fiera Milano S.p.A. the form available in the Exhibitor Platform within thedeadline.
Art. 23 MANAGEMENT OF WASTE MATERIALS
During set-up and dismantling times, the Exhibitor (or his representatives) is obliged to remove waste daily from the Exhibition Center, disposing of it in accordance with the regulations in force.
In accordance with Technical Regulations of Fieramilano Exhibition Center, the Exhibitor (or his representatives) is jointly liable for the correct disposal of the waste produced. It is forbidden for the Exhibitor (or his representatives) to dump any kind of waste inside the exhibition areas, both in the assigned space and in common areas (lanes, roads, etc.).
The ban on waste dumping and the related obligation to properly manage/dispose of the same should be understood as referring to all waste materials and materials resulting from assembly/dismantling work (packaging, materials used such as walls, false ceilings, floor coverings, etc.).
In case of waste dumping inside the Exhibition Center, Fiera Milano S.p.A. will apply a sanction of € 5,000.00 (five thousand euros), without prejudice to compensation for further damage, and reserves the right to bring legal proceedings with the competent judicial offices.
In the event of subsequent infringements, Fiera Milano S.p.A. will collect the access passes of the fitting company responsible for the dumping, and this for:
- the next exhibition, in the case of a second infringement;
- the next 5 exhibitions, in the case of a third infringement
Art. 24 STAND DISMANTLING
After the Events closing, stands must be dismantled by the scheduled deadline set out in the “Setting up and dismantling rules” notice at the latest. If this is not done, the Organizer and Fiera Milano S.p.A. accept no liability for goods, materialsand any other object left on the stand and reserve the right to collect and store them without any liability and at theexpense, risk and peril of the defaulter. Any objects not claimed after two months may be sold at auction and the proceeds,net of all expenses and anything owed to the Organizer, credited to the Exhibitor. The permanence of the ExhibitingCompany’s materials in the Exhibition Center also involves an obligation to pay Fiera Milano S.p.A. the fee for area utilization outside exhibition dates.
Art. 25 STAND DELIVERY AND RETURN
Before the start of fitting-out work, Exhibitors is required, on pain of forfeiting any defense, to verify on the spot the exact position of technical services and the size of the allocated stand; in the event of any discrepancy, Exhibitors must contact Customer Service – Assistance to Exhibitors.
At the end of the Events, Exhibitors must ask Customer Service – Assistance to Exhibitors to verify the pristine state of their stands. Any damage found when the stand is returned shall be added to its cost. Customer Service – Assistance to Exhibitors inspections must be requested at least three hours in advance.
Art. 26 DAMAGES CAUSED BY EXHIBITORS
Exhibitor shall be responsible for all damages caused to structures and equipment placed at his disposal. Expenses for restoring any modifications or damages shall be charged to the Exhibitor himself.
Art. 27 RULES ON WORKING MACHINERY
During opening hours, unless different advices from the Organizer, and further provisions contained in GeneralRegulations of the Exhibitions, machinery and equipment on display must be uncovered and can be freely operated for demonstrations, provided that:
- No nuisance to neighboring exhibitors and visitors due to noise, heat, vibration, pollution from solvents, etc.;
- Be positioned flush lane if protected by fixed screens, even transparent, or sufficiently set back from the edge of thelane and marked with distance barriers, provided with safety signs to prevent any contact with dangerous parts. Controlsof the machines, when placed in lane side, should be brought back to avoid occupation by operators;
- Correspond to the applicable European Community Directives concerning safety of machines (2006/42 / EC).Consequently, the CE mark must be affixed to them, with the characteristics required by this Directive;
- Exhibitors can exhibit and operate machines not complying with EC Directives provided that a visible sign “clearlyindicates the non-compliance of such machines … and the impossibility of them being available before they comply. Furthermore when demonstrating the non-compliant machines … appropriate safety measures must be taken to ensure personal protection” (Art. 6, paragraph 3, 2006/42/EC and art. 3, paragraph 7 Legislative Decree n. 17 of 27/01/2010);
- Where, for demonstration, inspection or maintenance it is necessary to operate with safety devices deactivated,Exhibitors must take appropriate security measures (mobile barriers, rigid protection screens, etc.) in order to ensurean equivalent level of protection to that required by the rules. Guards removed will still have to be placed next to themachine in a visible position;
- For machines and operating systems, for which testing is required by law, a special certificate to be shown to competent authorities and appointed bodies, in case of control, must be obtained.
Exhibitors are responsible for damage to persons or property caused by the operation of machinery on display in theirstands. Any danger seen by appointed bodies involve the automatic suspension of the power supply until the normal safety conditions return.
The Organizer and Fiera Milano S.p.A. accept no liability concerning Exhibitors activity during the Events or in relation to the products displayed.
Exhibitors shall hold the Organizer and Fiera Milano S.p.A. harmless from all and any third- party damages, costs and/orclaims that may be caused to said third parties as a result of Exhibitors activities during the Events or in relation to their products on display.
Art. 28 TEMPORARY PROTECTION OF INVENTIONS
The Organizer considers the protection of intellectual property as important for the development of industrial activities and therefore recalls Pres. Decree 338, effective August 22, 1979, abolishing the right to claim so-called “Exhibition priority” for machinery displayed. All relative patent applications must be deposited before the opening of the Exhibitions.
Art. 29 SAFETY AND HEALTH ON WORKPLACE
For the entire duration of the Events, including set-up and dismantling times of the stands and any other related activity, waste disposal included, each Exhibitor is required to comply with the most scrupulous observance of the entire regulatory system in force, also and especially with regards to protection of health and physical integrity of workers, and of labor law, social security and welfare legislation.
During stand setup and dismantling period and for any other associated or linked activity, Exhibitors further undertake tocomply with and ensure that all contractors working on their behalf comply with Fieramilano Exhibition Center TechnicalRegulations, of which Exhibitors expressly declare to know all amendments and additions therein, and provisions containedin article 88, subsection 2-bis of Legislative Decree 81/2008 and the associated implementational Ministerial Decree issued on 22.7.2014 by Ministry of Employment and Social Policies and by Ministry of Health.
All Exhibitors, in the exhibiting surface they have been allocated, as the subject who has legal responsibility for the area and therefore holds the position of primary guarantor toward the subjects who are inside the above mentioned area, shall have to adopt their corporate protocol and compel each of the aforementioned subjects to comply with regulatory rules to combat and contain the spread of COVID-19, according to the guidelines and protocols contained in the document dated 24thApril 2020, conveyed by the Government and recalled in Art. 29bis of Law Decree 23/2020. In particular, the Exhibitor shall have to make sure that both employees and third parties who are, to any extent, within the perimeter of their stand are correctly and adequately informed and fully respect the prescriptions about distancing, cleaning and sanitization of places and people, on the use of PPE, on behavioural measures (for instance, the obligation to inform the employer and to stay at home or to abandon the exhibiting are in case of a temperature, flu symptoms, provenance from areas with particular restrictions or prescriptions, contacts with people who resulted positive in the previous 14 days) and those prescribed by the above mentioned protocols/guidelines as well as by the Guidelines for the prevention of Covid-19 available in website www.simactanningtech.it or by the most updated and later prevailing ones, issued by Authorities in charge or transmitted by the Organizer. Even for access of the Exhibitors, the above measures will apply, as well as the prescriptions contained in the Guidelines above mentioned and the most updated and later prevailing ones, issued by Authorities or transmitted by the Organizer. Access of visitors and exhibitors shall take place with entry, transit and exit procedures, methods, paths and pre-defined and differentiated timing, if necessary with a fixed number, to the purpose of reducing occasions for gathering. At every access to the exhibition center, body temperature will be controlled (fixed limit: 37,5°C) by Fieramilano employees with a contactless hygienic system and correct use of face masks will be checked. The Exhibitor will be entitled to no compensation, reparation, reimbursement as a consequence of restrictions or limitations adopted by the Organizer and by the exhibition center to ensure respect of the measures described above.
Technical Regulations of Fieramilano Exhibition Center, which may be consulted in www.simactanningtech.it website (section “Exhibiting – Regulations and Technical Notes), also contain precautionary rules on exhibition safety (fire prevention,electrical installations, environmental protection etc.), excluding specific safety-related rules for activities undertaken by theExhibitor or contracted out by Exhibitors to contractors (stand set-up/dismantling and associated activities), for which theExhibitor remains responsible for oversight and compliance.
In order to comply with the obligations of the above-mentioned Ministerial Decree issued on 22.7.2014, the Organizeroffers access to these specific documents, Annexes IV and V of the Ministerial Decree, through Fiera Milano S.p.A. website.
Conduct that fails to comply with the above-mentioned safety regulations, in particular if they impact general safety in thepavilions and with regard to other parties in attendance, may be the object of prompt intervention by the Organizer and/orFiera Milano S.p.A. as part of regular checks and randomly, resulting in the immediate cut-off of utilities supplied to thestand or its immediate closure. Any additional consequence that may arise out of a failure to comply with the above-mentioned provisions is solely attributable to the responsibility of the Exhibitor and of the Companies appointed by the latter.
Fiera Milano S.p.A. may bar staff working for contractors/freelance workers operating on behalf of the Exhibitor fromthe Exhibition Center if they do not possess an ID badge as envisaged under article 18 subsection 1u, article 21 subsection1c, and article 26 subsection 8 of Italian Legislative Decree 81/08, and non-EU staff who, even if they hold an above-mentioned badge, do not have a valid and legible Italian residency permit or a valid and legible ID card.
This charge will be passed on to the Employer responsible for and the contact person for any barred staff.
As contractor, any Exhibitor who authorizes a company to operate in Fieramilano Exhibition Center on his behalf to carry out the work will be informed of the charge.
Exhibitors shall be responsible for complying with applicable laws and regulations regarding all works implemented andorganized under their responsibility and on their behalf, including set-up, structures, installations, products exhibited and all other associated activities.
Each Exhibitor must appoint a “Contact Person of the Exhibitor for the Exhibition Safety” (RSE) who will, for safety purposes, be liable towards all subjects possibly involved for all responsibilities in respect of the activities conducted on the Exhibitor’s behalf during the entire time of stay at Fieramilano Exhibition Center. At the Exhibitor's discretion, and under his full responsibility, the "Contact Person of the Exhibitor for the Exhibition Safety" (RSE) may also be a different person in each of the three stages mentioned above (set-up, Exhibition and dismantling).
The name of this Contact Person and the relevant telephone numbers must be communicated to the Organiser and Fiera Milano S.p.A. before stand set-up works begin and, in any case, before workers and materials enter Fieramilano Exhibition Center.
The names and contact details of the Contact Persons for the Exhibition Safety of neighbouring stands will be made available to Exhibitors at the Organizer and at Fiera Milano S.p.A. Each Exhibitor, through his own contact person for the Exhibition Safety, must work jointly with the Contact person for the Exhibition Safety of the neighbouring stand so that, through the exchange of information, it will be possible to identify any preventive measures to be applied to eliminate or, where this is not possible, minimize the risks of interference, where present.
If the name of the "Contact Person of the Exhibitor for the Exhibition Safety" (RSE) is not communicated, this responsibility will be held by the legal representative of the Exhibiting Company. Any changes to the name of the "Contact Person of the Exhibitor for the Exhibition Safety" must be promptly communicated to the Organizer and Fiera Milano S.p.A.
The most relevant obligation for the Exhibitor concerns the DUVRI [unified document for the assessment of interference risks], or the PSC [safety and coordination plan] in the event that, respectively, the rules contained in article 26 of the Italian Legislative Decree 81/08 are applied, or those contained in Title IV of the same decree, relating to work safety at construction sites, according to the provisions of Italian Interministerial Decree of 22 July 2014.This documentation must be uploaded to the appropriate section of the Fiera Milano S.p.A. Exhibitor Platform available to the competent Authorities (ATS and Police) and be present at the stand for the entire period of the event (including assembly and dismantling). Service providers working on behalf of Fiera Milano S.p.A. will only access the stand in the presence of the “Contact Person of the Exhibitor for the Exhibition Safety” and after authorization from the latter. The above restriction does not apply to personnel responsible for surveillance and security of Fieramilano Exhibition center.
Art. 30 MEASURES TO GUARANTEE PERSONAL SECURITY IN FIERAMILANO EXHIBITION CENTER
Fiera Milano S.p.A., in observance of the instructions provided by the Public Security Authority, has adopted the infrastructural, organizational and operational measures deemed necessary to guarantee the security of the individuals present for any reason in Fieramilano Exhibition Center.
Merely by way of example, the following may be provided for, at the unquestionable discretion of Fiera Milano S.p.A.:
- particular means of access to and exit from Fieramilano Exhibition Center (specific entrances/exits or reserved lanes, times, systems for the regulation and control of accesses and flows), which may be differentiated according to user categories;
- security checks, which may also be carried out with the aid of fixed or portable technical equipment and instruments, on people, baggage and personal effects, both when entering Fieramilano Exhibition Center, and at the inside of the same and, where necessary, at the exit from the same. The checks are carried out by Fiera Milano S.p.A. or by third parties appointed by the same. Without prejudice to notification to Law Enforcement Agencies and any measures that may be adopted thereby, users who do not agree to undergo controls will be prevented from entering Fieramilano Exhibition Center and, if they were already inside the Exhibition Center, they are immediately removed. Users subject to control are required to cooperate as much as possible, so that operations can be carried out with maximum effectiveness and with the greatest speed allowed by the nature of the activity. At the outcome of these checks, without prejudice to any communication of the fact to the Law Enforcement Agencies and the consequent measures taken by the same, Fiera Milano S.p.A. reserves the unquestionable right to inhibit suspected persons or objects from entering the Exhibition Center and if suspicious persons are already inside the District, to immediately remove them from the Exhibition Center, while suspicious objects must be immediately removed from the Exhibition Center by under the responsibility of their holders. Fiera Milano S.p.A. is not required to set up storage and custody services for suspicious items;
- variations or limits to pedestrian and vehicular routes inside Fieramilano Exhibition Center, including the positioning of barriers, new jersey elements, bollards and the like;
- forcible removal, at the risk and expense of the owner, of means of transport or work, objects or personal effects deemed suspect or liable to interfere with security checks.
The provisions in this paragraph are also applicable to all visitors and guests admitted to the Events.
Art. 31 ACCESS TO THE EXHIBITION SITE
In order to access and circulate in Fieramilano Exhibition Center, Exhibitor and/or company staff operating on his behalf must be in possession of a personal access badge.
To obtain these badges for set-up and dismantling phases, the Exhibitor must upload the required details in the Vehicle andPerson Pre-accreditation area of Fiera Milano S.p.A. Exhibitor Platform. The same area displays “Setting-up and Dismantling Rules”.
After entering the data, the Exhibitor will, again by email, receive bar codes that are read by special scanners on arrival on the Exhibition Center; the badges issued must be worn at all times.
The staff of companies operating on the Exhibitor’s behalf must also wear personal access badges as required by Italian Legislative Decree 81/08, carry an ID card and, in the case of non-EU staff, carry a valid residency permit or a currently validItalian ID card, as also indicated in Fieramilano Exhibition Center Technical Regulations. Please remember that anypersonnel not fulfilling access badge requirements and lacking the above documents shall be immediately banned from the Exhibition Center.
Access to parts of the Exhibition Center where maintenance and/or event set-up/dismantling works are in progress is strictly prohibited to unauthorized persons and minors under 15.
The Exhibitions are open to economic operators in possession of the prescribed access badge every day at the times established by the Organizer, who reserves the right to possibly change them also during the Exhibitions.
The Organizer shall provide special access badges, which must be requested in accordance with the procedures that will be communicated later, to allow free admission to Exhibitors and their staff during the Exhibitions.
Fiera Milano S.p.A. will provide appropriate car parking for Exhibitors. The Exhibitor must request the cards due, as they are already included in the services fee, by connecting to Fiera Milano S.p.A. Exhibitor Platform. Any other parking cards will be charged.
Please note that all occupants of transport vehicles accessing the Exhibition Center must have a valid entry card.
The Exhibitor is however responsible, for all purposes, for the behavior of those to whom he provides entry passes, as well as for the behavior of his employees, assistants and collaborators in the performance of the duties assigned to them.
Inside the Exhibition Center, it is absolutely forbidden for anyone to promote offers or donations for recognized institutions, beggars, political, religious or partisan propaganda and carry out activities not linked to the purposes of the Exhibitions.
Art. 32 PROHIBITIONS
It is not allowed, in particular:
- the distribution of gadgets, printed matter and advertising media, carry out propaganda including the use of branded third parties outside the stands and in Fieramilano Exhibition Center;
- the use of optical means, particularly effects, and strip lighting projected into the aisles or on ceilings or structures over 5,00 meters;
- any form of advertising for non-exhibiting Companies;
- any type of sound transmission not authorized in advance;
- any performance or entertainment initiatives, of whatever kind, nature and characteristics, even when limited to the stand or related to product presentation, unless authorized in advance;
- any equivalent exhibition and/or showroom and/or exhibition initiatives outside Fieramilano Exhibition Center;
- any promotional initiative outside Fieramilano Exhibition Center aimed at diverting all or part of the Events’ visitors;
- selling products exhibited for immediate delivery;
- using wall cavities to store materials, especially easily combustible ones;
- displaying signs stating prices;
- displaying products in contrast with the stand product category, as stated in the Application Form;
- displaying finished products for demonstrations, e.g. automobiles, motor vehicles etc. without prior authorization;
- using skates in general, including electric ones (push scooters, segways, hoverboards, roller skates), in the aisles and in Fieramilano Exhibition Center.

The Organizer is in no way liable for any activities carried out by Exhibitors during the Events and, in particular, for thedisplay of products in violation of laws, decrees, regulations etc., industrial property rights or for any Exhibitor actions that breach the rights of third parties or any acts of unfair competition.
Art. 33 HANDLING OF LARGE MACHINERY AND PLANTS
Large plant and machinery (single parts having width/height/depth over m 2,50) and/or with a significant weight MUSTenter the halls within the second setting-up day and MUST be removed starting from the second dismantling day.
Disregarding this provision, Fiera Milano S.p.A., as logistics supervisor, assumes no liability for delays and / or accessibility problems to the pavilion and to the stand due to existing installations.
Exhibitors who need to use OVERSIZE LOADS transportation for their machinery must inform Fiera Milano S.p.A. at least 15days before their arrival and agree on their access into the halls in the afternoon before the first official setting-up day.
Art.34 MACHINERY AND MATERIALS UNLOADING AND RETURN
Exhibitors must pay for all the operations linked to the introduction in Fieramilano Exhibition Center, unloading, placement in the stand, dismantling and reshipping of machinery, equipment and stand-design materials. The official forwarding agents of Fiera Milano S.p.A., see art. 19, are available for all operations linked to customs clearance and introduction of machineryand materials, including crane service and packaging collection, storage and return. They can also reship materials at the end of the Exhibitions.
Art. 35 SURVEILLANCE
Fiera Milano S.p.A. provides a general surveillance service of the halls. Exhibitors are required to supervise their standsthroughout the opening hours of the Events. They will have to safeguard the materials introduced in the stand during the setting-up and dismantling period and the opening hours. Valuables, easily removable, must be locked in drawers or cabinets.
Art. 36 INSURANCES
36.1 “All Risks” Policy of the Exhibitors (excluding claims arising from sabotage and / or terrorism)
The Exhibitor must have an “All Risks” policy on the whole value of goods, machinery, equipment and fittings taken into and/or used in the Fieramilano Exhibition Center with a waiver of right to claim compensation towards Fondazione Fiera Milano, Fiera Milano S.p.A., their subsidiary and associated Companies, the Organizer and any third party involved in the organization of the Events.
In case of subrogation from its own insurer, the Exhibitor guarantees to hold the aforementioned Subjects harmless.
Fiera Milano S.p.A. furnishes to Exhibitor, free of charge, an “All Risks” insurance with a limit of € 25.000,00, to cover all goods, machinery, fixtures, fittings and equipment brought to and/or used in the Exhibition Center by Exhibitors.
Coverage includes the stipulation of 10% insurance exclusion for each claim in the event of theft, with a minimum of € 250,00 and doubling this amount for the reports submitted after the closing of the exhibitions.
36.2 Third Party Liability Policy
This coverage is automatically provided, free of charge, for all exhibitors by Fiera Milano. This will become an extension of its general policy that has a limit of no less than € 100,000,000.00 (one hundred million).
36.3 Damage Reporting
The Exhibitor who has suffered damage must go to Customer Service – Assistance to Exhibitors and complete a proper form.In case of damage from theft, the Exhibitor must also make a complaint to Public Safety Authorities (Police) or to Carabinieri. The report and a copy of the complaint will be sent by the Customer Service to the Broker.
Art. 37 LIABILITY LIMITS
By signing the Application Form, the Exhibitor agrees to hold harmless Fiera Milano S.p.A. and the Organizer from any liability for consequential damages, reputational damage, loss of revenues, etc.
Also for any direct loss, since each Exhibitor has in custody/care the reserved exhibition spaces and is responsible for the goods contained therein, the Exhibitor agrees to hold harmless Fiera Milano S.p.A. and the Organizer from any liability, for goods/values covered and/or not covered and/or exceeding from the above mentioned Art. 36.
The Exhibitor acknowledges and agrees that Fiera Milano S.p.A. and the Organizer will not provide insurance services / policies, nor will it endeavor to procure any advantage that is in violation of laws, regulations, acts of authorities in charge or that may expose Fondazione Fiera Milano, Fiera Milano S.p.A., the Organizer, their subsidiary and associated Companies in sanctions, violation of prohibitions or restrictions established by UN Security Council Resolutions or other applicable regulations on economic and commercial sanctions. Therefore, the Exhibitor under these restrictions will not have any insurance coverage and release hereby Fondazione Fiera Milano, Fiera Milano S.p.A., the Organizer, their subsidiary and associated Companies connected to them from any liability for any harmful event that may occur within Exhibition sites that are owned /in availability / in management of the aforementioned subjects, nor will have any action, claim or request against such Subjects, for the aforementioned events.

Art. 38 LOCAL REGULATIONS – JOINT AND SEVERAL LIABILITY – CODE OF ETHICS
Exhibitors must comply with all existing local regulations, above all those on fire and accident prevention.
The Exhibitor is the sole person responsible for obligations ensuing from legal provisions regarding the contractor’s joint and several liability.
The Exhibitor declares to have read the Code of Ethics of the Organizer, available at assomacservizi.it, to share and accept in full the content and to refrain from conduct liable to constitute the offense referred to in Legislative Decree June 8, 2001 no. 231 aware of the possible consequences and penalties arising from the violation of the principles and standards laid out therein.
The Organizer and Fiera Milano S.p.A. cannot be held responsible for Exhibitor’s failure to comply with the above regulations.
Art. 39 NON-COMPLIANCE WITH REGULATIONS
The regulations contained in “General Regulations”, in “Technical Regulations of Fieramilano Exhibition Center” and in anyspecific circulars are intended to guarantee the best presentation, safety and orderly execution of the Events, offering all Exhibitors identical opportunities of presentation and participation.
SIMAC TANNING TECH management believes that only total and substantial compliance with the aforesaid regulations avoids unwarranted situations of privilege and danger contrasting with the interests of the Events and the Exhibitors as a whole.
Art. 40 ESCAPE CLAUSE
The Organizer may terminate the contract simply by written notification in the following cases:
- non-payment by the Exhibitor of the invoice for the balance of the fee as indicated in art. 9;
- declaration of bankruptcy of the Exhibitor or his submission to insolvency procedures in general;
- non-compliance by the Exhibitor with the obligations in Art. 36 (Insurance).
In case of termination of the contract in accordance with this clause, further legal and contractual remedies in favor of the Organizer are reserved.
Art. 41 RIGHT OF SEIZURE
In the event of the Exhibitor’s contractual default, the Organizer and Fiera Milano S.p.A. reserve the right not to allow theexit of displayed materials, without incurring any responsibility for any consequences.
The Organizer and Fiera Milano S.p.A. are not liable for any damage to display materials that may occur in applying the aforementioned right.
Art. 42 CLAIMS AND LIABILITY
Any claims must be submitted in writing to the Organizer, who decides totally at his own discretion and in the Events best interests.
In the event of any disputes of whatever nature not covered by the provisions in art. 35 and 36, the Organizer, FieraMilano S.p.A., their associated Companies and third parties, however involved in the organization of the Events, can in no case be asked to respond by more than the participation fee paid by the Exhibitor.
Art. 43 EXHIBITIONS POSTPONEMENT, REDUCTION OR SUPPRESSION
43.1 It is discretionary and unquestionable right of the Organizer to make changes to the Exhibitions dates and opening times, without this entitling the Exhibitor to withdraw or rescind the contract and release himself from his commitment.
43.2 Moreover, the Organizer may reduce the Events or cancel them in whole or in some of their sectors, without being liableto pay compensation, penalties or damages of any kind. In such cases, the Organizer must communicate the changesimplemented by a written notification, by registered letter, certified email (PEC) or telegram, to be sent at least 30 daysbefore the scheduled Exhibitions opening date.
43.3 In the event that, as a consequence of the further spread and/or possible aggravation or in any case of the dangerous situation in Italy for individual and/or collective public health deriving from the epidemic called “Coronavirus”, the Events were canceled without the possibility of taking place within the calendar year, with the total preclusion for Exhibitors from participating in the Exhibitions themselves, the Organizer will refund the registration fee and any participation fees already collected.
43.4 In the event that, as a result of the further spread and/or possible aggravation or in any case of the dangerous situation in Italy for individual and/or collective public health deriving from the epidemic called “Coronavirus”, the Events were canceled and, within a reasonable time, a new date is indicated by the Organizer in the calendar year, suitable for holding of the Events (without prejudice to the necessary concomitance of the same with further events of the sector: eg Lineapelle, Mipel, Micam, etc.), the Organizer reserves the right to withhold the amount paid by the Exhibitors (registration fees and participation fees already collected) by way of payment for participation in the Events on the new fixed date, always without prejudice to the provisions of Art. 2 of these Regulations.
Art. 44 LAW IN FORCE AND EXCLUSIVE PLACE OF JURISDICTION
The present General Regulations are subject to laws of the Italian Republic.
Any disputes linked to validity, efficacy, interpretation, execution and termination of the present General Regulationsshall be referred to the legal jurisdiction of the Court of Milan, with the exclusion of all other alternative or concurrent courts.
Art. 45 EXHIBITOR PERSONAL DATA PROCESSING
- For the purposes of this Article 46, the terms and expressions, where they are not defined in these General Regulations, will have the meaning attributed to them by Regulation (EU) 2016/679 and by the laws, regulations or legal instruments implemented pursuant to the same. (hereinafter also referred to as the "GDPR") or otherwise applicable.
- The Exhibitor declares to be informed that the provisions of Regulation (EU) 2016/679 concern the processing i) of data relating to natural persons ("Personal Data") and therefore they are not applicable to legal persons (companies), organizations and associations, nor with regard to information ("Information") referring to such legal persons, for which only the rules relating to the sending of commercial communications remain firm and applicable (see, in particular, Article 130 of Legislative Decree 196/2003 as amended by Legislative Decree 101/2018), for which the Exhibitor (legal person, organization or association) is also required to give prior consent to the sending of such communications for direct marketing purposes.
- Personal Data referring to the Exhibitor, when operating as an individual company, a small business owner or a professional, as well as to their representatives, members, employees and collaborators, indicated in the Application Form or even subsequently released, as well as those acquired from or through third parties (e.g.: management company of IT applications used by the Exhibitor or by Assomac Servizi Srl, for organizational purposes – e.g. web APP "Simac Tanning Tech", partners, commercial information company, etc., to which the Exhibitor has conferred - pursuant to the RGPD - his Personal Data for the purposes of participation in the Events) or in the context of the Events (including, for example, any photos or video recordings at the stands: see art.5, or any data collected and / or recorded during the access and / or attendance control activities carried out by Fiera Milano S.p.A., using electronic systems at the entrance to the Events themselves) are collected and processed by the Organizer and Fiera Milano S.p.A. in the terms described in the Privacy Policy attached to the Application Form.
- The Privacy Policy referred to in the previous paragraph is provided by the Organizer and Fiera Milano S.p.A. pursuant to art. 13 of the RGPD and the Exhibitor undertakes to communicate it to natural persons (his representatives, exponents, employees and collaborators), to whom the Personal Data provided for the purpose of participating in the Events and the provision of related services refer, as well as to guarantee that the Personal Data can be lawfully and independently used by the Organizer and by Fiera Milano S.p.A. for the aforementioned purposes (as well as for the additional purposes set out in the aforementioned Privacy Policy) and to release and / or indemnify the Organizer and Fiera Milano S.p.A. for any cost or damage resulting from the violation by the Exhibitor of the obligations undertaken pursuant to this Article towards the Organizer and Fiera Milano S.p.A ..
Art. 46 ACCEPTANCE OF EXHIBITION’S GENERAL REGULATIONS AND TECHNICAL REGULATIONS OF FIERAMILANO EXHIBITION CENTER. CONTROLS
By signing the Application Form, the Exhibitor agrees to accept the General Regulations and all the additional decisionsadopted by the Organizer in the interest of the Events. Anything not expressly stated in these General Regulations (andcompatibly with them) is governed by Technical Regulations of Fieramilano Exhibition Center.
The Organizer also reserves the right to issue a justified expulsion order against an Exhibitor: in such cases, the Exhibitor is not entitled to reimbursement or compensation for any reason.
Except as established by the individual provisions, the supervision of compliance with the General Regulations is entrusted to the staff of the Organizer, to the competent offices of Fiera Milano S.p.A. and possibly to third parties (natural or legal persons) appointed by them.
The Exhibitor is required to provide all other documentation that may be requested to decide on the acceptance of the Application and ensure compliance with the terms of participation in the Events.
For all questions concerning the interpretation of the provisions and all subsequent notices, additions, changes and derogations of the present General Regulations, the Italian language version shall be binding and the Italian Law shall be applied.
